The Spam Act, briefly

A national business usually leans on email and SMS as well as search. Australia's Spam Act 2003 sets three rules for commercial messages, and the regulator enforces them firmly: Telstra paid $626,000 in 2025 after its unsubscribe process asked people to log in first.

Prices, GST and the Australian Consumer Law

Australian shoppers expect prices shown with GST included, and the Australian Consumer Law treats misleading prices and hidden fees seriously. Show the total price, including any compulsory charges, wherever a price appears, including in search results and shopping listings. Consumer guarantees mean faulty goods must be repaired, replaced or refunded whatever your returns policy says; change-of-mind returns are a choice, not a legal requirement, which matters for intimate products that cannot be resold once opened. A clear returns page that explains both, linked from every product, prevents disputes and answers a question shoppers search before buying.

Delivery across a big country

Delivery from Sydney to Perth, Darwin or regional Queensland takes longer and costs more than within the east coast, and shoppers in those places search specifically for delivery times and costs. A single delivery page that sets out times and prices by state, explains discreet packaging and names the carriers you use helps every shopper, and it can rank for delivery-related searches that thin state pages never would. Email and SMS under the Spam Act

The Spam Act requires consent before commercial emails or texts, clear identification of the sender, and an unsubscribe that works without a login and takes effect within five working days. The ACMA has enforced it firmly. For adult brands sign-up forms here carry plain wording and an empty tick box, every consent is logged, and write subject lines and sender names that are discreet on any screen. A list built this way is worth more than a bigger list built carelessly, because it can be used without risk.

Writing for the whole country

Most of an Australian adult store's search traffic comes from three kinds of page: categories named the way Australians shop, products described with local units and prices, and a small set of buying and care guides. Spelling matters more than people expect; "colour" and "centimetres" signal a local shop, and so do prices in AUD with GST included. Three time zones, two daylight rules

Australia runs on Eastern, Central and Western time, and daylight saving only applies in some states. From October to April, Sydney and Melbourne move an hour ahead while Brisbane does not, so a 7 pm email sent from Sydney reaches Queensland at 6 pm and Perth in the afternoon. Schedule emails, posts and sale end times with that in mind, and state the time zone whenever a deadline appears on a page. A sale that ends "at midnight" should say whose midnight.

Selling across the Tasman

Many Australian adult stores also ship to New Zealand. Shoppers there expect prices in New Zealand dollars or a clear conversion, delivery times and costs stated plainly, and returns information that applies to them. New Zealand has its own goods and services tax rules for overseas sellers, so check your obligations with an accountant before promoting the store there. Marketplaces as a channel

Some Australian adult retailers also sell through marketplaces, each with its own rules on adult products, images and wording. Marketplaces bring shoppers who are ready to buy, at the cost of fees and limited contact with the customer afterwards. Use them to introduce your brand, keep product details consistent with your own site, and include packaging inserts that invite buyers to your store for their next order. Never let a marketplace become your only channel.

Privacy law is changing

A long-promised overhaul of Australian privacy law began with an amending Act that Federal Parliament passed in late 2024. Among other changes, a new statutory tort for serious invasions of privacy took effect on 10 June 2025, allowing individuals to sue in some cases, and further reforms are expected. For adult businesses, whose customer lists reveal sensitive information by their nature, the safest course is to collect only what you need, explain clearly how it is used, secure it well and delete it when it is no longer needed. Seasons that drive Australian sales

Australian retail has its own calendar: Valentine's Day in February, end-of-financial-year sales in June, the Click Frenzy and Black Friday period in November, and Christmas in the middle of summer. Questions

How fast must we honour an unsubscribe?

Within five working days under the Spam Act, free of charge, and the unsubscribe option must keep working for at least 30 days after the message is sent.

Can we ask for a login before someone unsubscribes?

No. Telstra was fined $626,000 in 2025 partly because its unsubscribe required a login or extra personal details.

Are incentivised or invented reviews allowed?

Invented reviews are misleading under Australian Consumer Law. Genuine reviews from real customers, shown fairly, are the only safe approach.

Do we need separate pages for each state?

Only where something genuinely differs, such as delivery times or a store. Near-identical state pages tend to compete with each other.

Do we have to accept change-of-mind returns?

No. The Australian Consumer Law requires remedies for faulty goods, but change-of-mind returns are your choice. Many adult retailers exclude opened intimate products; state your policy clearly.
